In consideration of the respective covenants contained herein, the parties hereto, intending to legally bind hereby, agree as follow:
Cancellation of the engagement by the Client for any reason shall forfeit the deposit. Cancellation of the engagement by the Client within 30 days of the date of engagement shall also require payment of balance. If the Service provider cancels the contract, the balance and deposit will be refunded to the client.
The Service Provider cannot be held liable for any delay in set-up caused by the Establishment or other service providers. The Service provider cannot be held liable in the event of loss of power. The Service Provide cannot be held liable for technical glitches, which include but not limited to: the sudden and unexpected failure of CD players, speakers, amplifiers, lighting, wireless communication and/or special effects. In such an unlikely event, the Service Provider is expected to rectify the situation in a reasonable time and manner.
The Service Provider is required to perform a sound check during set-up lasting approximately 30 minutes at which time music can be expected to be played at peak levels.
The DJ reserves the right to deny any guest access to the DJ’s music and/or equipment. The DJ is charged with the responsibility of keeping the majority of the guests on the dance floor and as such, reserves the right to select the order in which the music is played.
The Service provider reserves the right to refuse the playing any CDs/DVDs or other medium if in their judgment the medium may potentially cause damage to their equipment, or if the nature of the content on the medium is not at level of quality suitable to be played on professional equipment.
The Client at the end of the Main Reception must claim any and all articles provided to the Service Provider over the course of this agreement. The Service Provider is not responsible for returning such articles after the end of the Main Reception.
The Client ensures that:
(A) place of engagement or caterer shall provide the Disc Jockey (DJ) with a sturdy, covered 6′ or 8′ DJ table within 25′ of a 45 Amp 3 prong grounded electrical outlet(s) and sufficient distance allowances for speaker and lighting set-up;
(B) The place of engagement is open and available to the DJ at least 5 hours before the scheduled starting time;
(C) The place of engagement meets all Provincial and Federal safety regulations and has any and all necessary music licenses and performance permits;
(D) For all outdoor performances, unless waived by the DJ, a tent or similar overhead protective covering must be provided to prevent damage to the DJ’s equipment in the event of adverse weather conditions;
(E) Reasonable steps will be taken to protect the DJ and his equipment & music collection from any type of abuse, theft or damage resulting from this booking.
